Changing jobs on TN visa

Post Sun Jan 10, 2010 9:09 pm

I'm currently on a 3 year TN visa and am only 6 months in. I'm in a situation where I need to change employers. I was wondering if I do the switch using the I-129 form do I need to send in all of the same paperwork as I needed to obtain the visa originally (ie. reference letters, transcripts, degrees)? Also if I am changing employers is it possible for me to extend the for the full 3 year period again?

Also do I need to submit paperwork to change my wife and sons Dependent visas as well?

Thanks

Your new TN will be for a new period, upto 3 years. You need to be in a legal status for your new employer to file I-129 for TN from US -- so you can't be already laid-off. And you can't start at the newemployer until you avtually get TN, so you will need tof tile premium processing to ensure quick approval -- all same apperwork as at border. Most in your position simply go to the border.

Your family has TD's based on you having a TN -- any TN. So they don't need to do anything as lond as you continuously maintain TN status.

That is a big help. Thank you. I was thinking of going to the border crossing but thought my family would also need to accompany me if I did that. If I were applying to have the visa to be extended for a new 3 years my I-94 card in my passport would have a different expiry date than my dependents. That's where I thought that I would need to also file to have my dependents I-94 cards with the same expiry date as me. Would them having different expiry dates create any problems in the future?

Thanks

The different expiry dates will only cause a 'problem' 2.5 years from now, which assumes you hold on to the next job 5 times longer thatn the current one.

Plenty of time for them to get a new TD anytime they next cross the border between now and then. No need to drag them along for your TN process.

I have the similar situation.

I changed jobs this week. Last Friday was my last working day with previous employer and I am going to the border tomorrow to get my TN Visa.

Does this imply, based on your answer above, that my family does not need to get their new TDs visas as long as I maintain my TN status?

My wife TD was stamped from consulate in Toronto, Canada as she does not have Canadian passport yet. It is a valid 3 year sticker visa.
Does she need to make another visa application for her TD?

Hi - I didn't see a thread that answered my question exactly, but everything seems to be close to what I'm after. I am currently 6 months into TN status and I'd like to switch employers. I have a new job offer and am all set to give two weeks notice at my current place to head over to the new job, but I'm not sure when the best time to apply for a new TN would be. I would love to secure the new TN by driving to the border, BEFORE giving my two weeks notice, but I'm not sure if this is allowed. Can I drive to the border tomorrow, get a new TN for a full-time position, then finish off two weeks at my current full-time position? THANKS!!
