Changing the employer while on the TN visa - Nebraska?

Postby The_Knight » Sat Jul 18, 2009 3:46 pm

I'm on a TN visa and it's good for another 5 months. However, I'm changing employers. I read a thread about this and people seemed to be in disagreement between applying for a new TN....

I read this very interesting option: TN-1 Canadians may change employers or add an employer by filing Form I-129 with the Nebraska Service Center... what's the documentation needed for that? In this case, would my revised TN last 5 months, or will it last a year? Who pays for the premium fees? Me or the employer?

- Finally, last time, the TN Officer was going to reject my application because my "Academic Equivalency Evaluation" was not from a Canadian governmental entity... Are there any Canadian Corporation that handle this?

Basically the new employer can file an I-129 for you and effectively you apply for TN-1 from inside of the US. Who pays the fee is academic but it's supposed to be the employer. The advantage is that you don't have to leave the US but the downside is that if there any questions about your application, USCIS can't ask you. So sometimes it's better to re-enter. Depends on how straightforward the application is.

I-129 is a complex form to fill in so be clear with your employer that they know what they're doing as well, if they're unfamiliar with immigration forms you might end up in a mess.

Not sure about your qualifications, depends on your NAFTA category as to what they will accept.

Thanks...
Yeah I saw the form, it really is complicated. I guess I'll take the letter and re-enter... as it's bad enough that both my employers haven't heard of a "TN visa" before....
