College Teacher Category under TN Visa

Hi, I've looked specifically for this question on this forum but haven't found anything. My husband is currently on his OPT in the US. His OPT expires in October which by then he would have to return to Canada. I'm currently in the middle of completing my degree here as well in the US. My husband has pursued his MBA and would like to teach business or a subject relating to the degree in the US. Now if he were offered an instructor position at a college, would he be able to receive his TN under the teaching category?

I would appreciate any help that can be provided and not necessarily educated guesses from what I've been reading.

—College—Baccalaureate or Licenciatura Degree.

—Seminary—Baccalaureate or Licenciatura Degree.

—University—Baccalaureate or Licenciatura Degree.

Yes, college/university instructors are on the NAFTA Professional Job Series list, so he would qualify for a TN.

I thank you for your prompt responses. I just want to make sure you understand my question.

Being an Instructor may be different from being a Teacher in the eyes of US immigration. If he is offered a position as an instructor instructing students, will he be able to receive a TN as an instructor at a college?

Being an instructor comes with a little less responsibility than being a teacher. So I just want to make sure.

In my mind, they are the same but if you say it is different then it will come down to his job description. His job description should match that of the OOH: http://www.bls.gov/oco/ocos066.htm

Hi,

In addition to looking at the Occupational Handbook (http://www.bls.gov/oco/ocos066.htm) for the official job description, ensure your specific Instructor/Teacher job meets NAFTA's requirements by requiring a degree and the job duties/description are inline with that mentioned in the Handbook. Also, it does not have to be exactly the same as all jobs have slight differences depending on the company's needs.
