Collet UI from a job in the US while on TN Visa

Post Mon Nov 02, 2009 11:50 am

I've been working in Michigan for almost 2 years. I was recently let go from the company due to downsizing (about 2 weeks ago). I moved to Michigan about a year ago, registered my car and have a MI drivers license. I'm actively looking for a new position while I'm still here. I guess I have a few questions:
Do I have to leave and go back to Canada?
If I travel across, will they let me back into the MI to return to my apt.?
Can I collect UI from my past US employment?

I would like to stay in MI and find work. Sorry if my details are vague, but any assistance or feedback would be greatly appreciated.

I do believe if you've been let go from your job while on a TN, there is no grace period which means you need to head back to Canada asap.

I would just get my belongings organized while still in the U.S before heading back to Canada just in case immigration decides not to allow me back in.

UI I'm not quite sure about but I've read conflicting theories that you cannot obtain it and some that say you can obtain... Anybody else can add along to this....

ince you are out of status, yes, you should be planning your quick return to Canada.

As to UI, you genrally need to go back to canada to collect UI based on TN work, since you fail to meet the 'immediately ready to work' criteria, since you are out of status. However, MI being a border state may have some leeway to accept you looking in canada and Michigan while remaining in US. Only moving back to Canada guarantees UI. but chech locally with MI UI.

But to remain in US you would have had to switch to B2 status by mail, or re-established residency in canada.

Since you filed to file B2 the day you lost your job, that option is out, so yoy choicesare find a job this week, or leave.
