But sorry, another question for you....

US citizens (and LPRs) MUST file a 1040 return every year regardless of where they live. They can't complete the I-864 without copies of their returns and it explains this in the instructions.

Is this I-864 form something that will come up AFTER we file the I-130...?
(B/c so far I have not seen that listed as something we need WITH the I-130...or am I wrong about that...??)

Your spouse will have to fill in the I-864 affidavit of support so that you can take it with you to the interview. This gives you some time to get any back taxes done if you need to.

He will be required to file US income tax returns for the years he has been in Canada, to a maximum of 7 years.

IRS might ask for that, but USCIS only wants three.

Either way, if he's been gone long enough and hasn't been filing taxes, he'll need to do 7 years worth
