Criminal Charges was Withdrawn

Post Tue Sep 23, 2008 4:13 pm

Hi,

I am a Canadian Citizen who lives in Toronto area. My Criminal Charges for Sexual Assault and Indecent Act (Sept 27, 2007) was Withdrawn in Ontario Court of Justice on July 18, 2008. I was issued and asked to sign a Peace Bond which will expire after a year, that is on July 18, 2009. I understand that I have no criminal record, and to be sure of this, I secured a Police Clearance in one of the RCMP agencies, and it stated there that I have NO Criminal Record, no pending charges or warrant of Arrest. I also have a copy of the Court Information which I paid for $75.00, thru my Lawyer. I can only request for the Destruction o my Photo and Finger Print once my Peace Bond expires next year.

My question is, will I be allowed entry to the U.S.? Do I need to secure a U.S. Waiver to have access to the U.S.? Isn't U.S. Waiver for persons with convictions and criminal record?

For additional information about my identity, I am a family man, in my late 40's and I work in one of the Banks here in Downtown Toronto for almost 3 years now.

Can someone please give me a clarification on this matter as I am getting so paranoid.

Thank you very much.

AFAIK it sounds like you haven't been convicted of a crime so you should be free to travel to the USA. However, I know that they can ask, at the border, whether you've ever been arrested. I don't know what happens if you--truthfully--tell them that you were arrested but not convicted.

You might get more information by posting to this website that specializes in US waiver cases:

It doesn't sound like you need a waiver but you might get a more knowledgeable answer there.
