Denied access to U.S. while CR1 visa processing

Two weeks ago I flew up to Canada with my daughter (who is dual since my husband is American) so she could spend Christmas with her Grandma. But as we were crossing the border to drive to the airport in Detroit (to fly back to LA) the U.S. border guards would not let me back in. Even though I had evidence with me that I'm in the final stages of receiving my green card, they told me it was because I had stayed 11 months in 2010 rather than 6 months and was considered an illegal immigrant with intent to live in the U.S. I was fingerprinted and treated like a criminal in front of my 2 and a half year old daughter. My husband is devasted becasue of this and has already flown up here for a week to see us. I have to wait for my green card before I can cross again. Anyone else out there have this happen to them? This sucks!!!!

The rule of thumb in U.S. immigration law is that you are considered to be an intending immigrant unless you can prove otherwise. I am assuming that you already applied to adjust your status in the U.S. as a conditional relative and were waiting for an interview. If I am correct in this, then your file will be transferred to Canada and you will have your immigrant visa interview, after a lot more time has passed, with the U.S. consulate in Montreal. If you provide more details, I will try to help you with your situation.
