Denied entry into the US; live with parents in Toronto.

Hi,

Recently, I have been denied entry into the US, for being unable to demonstrate sufficient ties to Canada, and thus being unable to convince them that I have enough reason to return to Canada. I have lived in the States under a TN visa for some time now, which has fairly recently expired, so I suppose I understand their concern.

I would like to visit the US again. However, I am only 24, and I don't have a place to live on my own in Toronto, my hometown, and I live with my parents. Because of this, I do not have things to show that I own a residence in Canada, such as utility bills, or rent invoices. The POE officer did mention that it is somewhat understandable that someone my age would not have things such as a lease agreement or utility bills to show, but at the time I had no other receipts to produce to them at the border, which led to me getting denied entry. If I wish to attempt to re-enter, what kind of proof that I live in Canada can I offer them, that aren't utility bills, a lease agreement, or proof of employment (e.g. pay stubs)? Will I able to produce a sufficient amount of proof without these sorts of things?

I feel that it must be difficult for people who live in Canada to produce such evidence if they are in situations like I am, where their residence is not under their name and are unemployed, which seems very unfortunate.

Also, I am looking into obtaining a "US Entry Package," which is a package put together by an immigration law firm that details one's ties to Canada, including a cover letter which states that the subject of the package wishes to enter the US as a genuine temporary visitor. However, from very rough research, it looks like it costs around $1800, so I'd like to know how helpful it really is for re-entry in situations like mine, before I invest such a large sum of money into it.

Indeed, once you have recently lived in US, the burden of prrof is on you to show that you have FULLY re-established ties in canada.

You shouldby now have a DL from your province, and a newly issued health care card. If you are recently unemployed (even from TN in US) you should be collecting EI, so that would be your paystub.

The US has the right to refuse entry to anyone the feel will not leave. Their answer to your claim tha tthis is unfortunate would likely be "fix your fortunes in your own country first, then come visit. :-({|=

You would be crazy :shock: to pay anyone a nickel for the piece of crap that lawyer is trying to pawn off. Even they can't make silk purse out of a sow's ear.

How bad does my situation look? How likely is it if I cross with only a driver's license, a cell phone bill, a health care card (I don't know why it would be newly issued, I only have my original one) and a return flight home, that I'll be granted entry for visiting?

Also, what happens if I get denied entry more than once? Does the black flag somehow accumulate? It sounds a little silly, but I've planned a trip with my friends in the States in a couple of weeks, and I'd like to try my best to attend.

You said you were living in US for some time. That means your healthcare had expired and you would have naturally given back your card, as you were supposed to do. Thus you would now be getting a new one.

You have no option but to try.

First off, let me know what happened to you if you decided to go back with only that much proof. I too lived under a TD Visa until turned 21 (I'm almost 23 now). I lived up in London with my brothers and had a lease and all but went to visit for 3 months after moving out. (First off bad idea) I was issued temp stay. Now I'm with my brothers, don't have a job (I was offered one while in the states, so I'm trying to go back and register through Immigration which is WAY faster) and don't have a lease. I've called times asking about re-entry and they tell me that I don't have sufficient evidence of ties to Canada but do as I wish. E-mail me and I'll tell you what I'm attempting to get "sufficient" evidence.

Oh right. I was always fine in crossing the border before and was only denied because of applying for the wrong work visa and then they connected saying, "you've lived in the states so long and now you don't have ties in Canada DENIED"
