My TN application failed miserably. Here is the steps I took in point form.

1. Called the US Consulate in Halifax. Got the 900 number.

2. Spent $20 on the phone got the info needed to get TN visa at a border crossing.

a) TN Letter stating employment period, pay and job description.

b) copy of diplomas (proof of skills)

Told 1-900 number what I was going to do (Sound System Design), was informed that the job would fall under "Computer Systems Analyst"

3. Got TN letter from employer for computer systems analyst.

4. Drove a day and a half to Houlton Maine Border crossing. (On a sunday)

5. Was told that my background was not that of a Comp. Sys. Analyst. Advised to change my documents from employer to Scientific Technician/Technologist. Was told to come back tuesday to meet the TN specialist.

6. Called employer, got new documents.

7. Arrived at border on tuesday, saw the TN specialist he said that the job I was aiming for was a drafting job not a technologist job. And a draftsman is not recognized by NAFTA. I argued that I had been a technologist and that drafting was one of the duties of a Technologist. He went to his occupations book to find out what a draftsman job is. He looked at my diploma (Architectural Drafting) and said your a Draftsman doing a drafting job and denied my application. He said I can't appeal it and accused me of changing my documents to suit my needs even though I had been advised to.

8. He then told me about a J-1 visa which I could buy online for $200 that would give me immediate entrance no questions asked. I told him it sounds "Sketchy at best" he said thats the way to get around the TN-Visa.

MY QUESTIONS:

Why would he tell me the loophole but not help me gain approval of my application?

How long do I have to wait before trying the same TN Visa Letters at a different port of entry?

What is my next option?

Final notes

The employer still wants me. I plan to get an immigration lawyer to help me out. Is this beneficial?

I found some extremely good advice from TN visa Expert website. I purchased their "how to" kit that contains information from what happens if you are rejected, how to word the TN offer letter, to much much much more. It is totally worth the $80 price tag as it contains all the information that you need in one spot. There are even sample offer letters included. Best of luck.
