Dependant Green Cards is the US?

Postby stevecc » Wed Oct 14, 2009 6:46 am

My husband is considering jobs in Florida, he is a journeyman lineman. If he is issued a green card sponsored by an employer, do my children and I need green cards? How long does that take? What category would we apply under? Thank you so much to anyone who can help us. The immigration website isn't exactly easy to navigate.

If you're husband is offered employment in the U.S. as a journey lineman and manages to retain a greencard through employment, then yes you and you're children will be sponsered as dependents (Depending on age of children).

The length of time this will take all depends on the category your husband would fall under such as EB 1, 2, 3 etc... If he falls under 1 or 2 being extraordinary ability or outstanding etc, etc, then the process will be current providing he has ALL the proper credentials.

Any category after that will take several years starting with EB 3..

Your husband may require an H1B visa from the sounds of it if his profession falls under a specialty category. The green card bit is not automatic. It's very difficult to obtain if your field of work is not recognized.

I don't believe his profession falls under EB 1 or 2 so the employer would have to apply under EB 3 if they are going to apply straight to permanent residency. Again, this is a long and grueling process so be prepared for a slow and painful wait if anything :(

IF he gets a green card to live in US, then yes, you will all need green cards to live with him.

Not to be overly pessimistic, but since lineman is not a profession for which any temporary status would be available (TN, H1), a green card would be the only way he could go and work in US. He could possibly be transferred temporarily under an 'L' visa, if working for a sister company. I doubt that any company would go though the trouble and expense of getting a green card for such a position -- and even if they were willing, they would have great difficulty in proving that he is uniquely qualified over all US lineman.

He would thus need to qualify for a green card by othermeans, like a US citizen relative.

In any event, such a process would take at least 8 years.

Now, if he were a football offensive or defensive lineman, that might be a different story.

Well, they could file I-140 for regular EB-3 rather than skilled worker, but those take ages to get. Generally speaking the employer must really like you to wait years to get you, usually it's someone doing someone a favour or there is some sort of family relationship, but not close enough for I-130 to work.

Dependents are included in the application when the petition is approved, that bit isn't the problem.

And skilled worker or not, he is simply not unique and in demand to meet PERM requirements.

About 500 applicants would submit their resume on day one, not to mention the union issues involved.
