Divorce, spousal visa and toddler citizenship

Post Mon Nov 29, 2010 4:43 am

Hi. I'm a Canadian citizen married to a Brit. I'm in the UK on my spousal visa which is valid until March 2011. I'm in a middle of a divorce and will be returning back to Canada with my son who was born in the UK in 2009. My questions are: if the divorce is not finalized by March can I continue to stay in the UK? Do I have to get my son's Canadian citizenship before returning to Canada or can I do that when I get back to Canada? Any advice would be helpful. Thanks.

You can stay until the divorce is finalized, but you'll have to leave before your visa expires.

You don't have to claim your son's Canadian citizenship, but you'll have to get him a passport before travelling.
