Do I get a TN1 or a job first?

I'm looking to go to the US through the Hospitality Industry option on the qualifying list for the TN1 form. My problem is, is that most of the jobs posted say that they won't consider applications from people who are not already able to work in the US.

Can I get a TN1 form without having a job first or can I at least get it started in hopes of being able to say my visa's "in the mail" so to speak?

Anyone have any suggestions of getting around this?

When I filled out job applications, I said I was eligible to work in the U.S. When I interviewed, I told them what I needed. On both interviews they agreed and offered me the job.

Make sure that the job you are going for is on the list of approved TN jobs! I don't know what is in the hospitality industry though. The only people that wouldn't talk to me is temp agencies so don't even bother talking to them - it's a waste of time. None of them would even consider me.

BTW you need a job offer in order to get the TN. You can't get a TN first.

It's illegal to ask that question under the EEOA.

Sort of. They are not allowed to ask if you are a US citizen or ask any questions about citizenship. They can, however, ask you if you are eligible to work in the US. If you are asked this question during an interview, you don't answer 'no' -- you simply state that you are eligible to work in the US on a TN, and explain what a TN is and how their involvement in your obtaining a TN is minimal.
