Do you need a Visa first before ILR approval?

Post Thu Oct 07, 2010 11:35 am

Husband is British-born and his remaining family still resides there. I am Canadian. We have been married and lived together outside of the UK for more than 4 years.

I read on the WorldBridge site that upon arrival to the UK and based on our length of marriage (at least 4 years) and having lived outside of the UK for that long that I may be able to qualify for ILR (Indefinite Leave to Remain) status immediately (naturally upon UK Border Services approval).

My question is, do I need to apply for the Spousal Settlement Visa first and then apply for ILR? Or, can I just fly to the UK based and upon arrival, request for ILR status?

This may sound very simple and I'm sure it is. The clarification I want is whether or not we are spending £644 for the Spousal Settlement Visa and another £840 for ILR.

Any help would be greatly appreciated.

Regards,

I am almost positive but look again on the UK border site but you only need to apply for a ILR its the form(M) on the site but if you go there they will direct you to proper form for your situation,

good luck
