Does Canadian citizen need an I-94 form for TN approval?

Post Tue Dec 02, 2008 8:35 pm

I am a Canadian citizen and I am now in US as a visitor (B2 status). I need to change it to TN-status for employment, and recently a potential employer asked me if I have a I-94 form when I entered the States (which is not required for a Canadian). However, they said if they want to sponsor my TN status, they have to get the I-94 form first. Is that true? I don't want to go to the border for an I-94 form and come back for an employment letter and go to the border again for TN-status. Any other ways to get that I-94 form without going to the border again? Thank you so much for your time!

No, you don't even need an I-94 in TN-1 status either, most people get it because it saves having to re-apply when you re-enter, but if you're not planning on leaving and re-entering while you're in TN-1 you don't need an I-94 (although it helps with other things like getting a driver's licence).

All you need is the letter (and the other things you need like proof of your qualifications) and then you can go to the POE and apply.

It says quite clearly on Form I-94 that Canadian visitors don't need to fill it in.

Thanks steve for your reply.

Actually, a potential employer want to hire me, but they never have experience hiring anyone who need a TN-status. Do they have to file form I-129? OR any other forms?

Well there's plenty of info on here about what is needed for TN-1. The only thing you need from the employer is a really detailed job offer letter saying how long they want you for (3 years max.), what the job is, why you qualify for it, what qualifications are needed for it, what NAFTA category it fits into, etc.

You can get it by applying for AOS using an I-129 but it's simpler to go to the border and it can often be cheaper as well as TN-1 costs $50 but I-129 costs $320. It's certainly a lot faster, plus you're there to answer their questions so that also can help.
