Domestic Partner on B2 Status in the USA, Driver's License?

Post Thu Nov 11, 2010 8:35 am

Hi,

I am a Canadian, in the USA with my domestic partner/common law spouse. He is here on an L1 work Visa with his company. I was granted the B2 status for 6mths and had it tied to his Visa as a Domestic Partner. Because I am here under the B2 status, I cannot get (my understanding so far :) a SSN. So, the utilities for our rental etc. are all being obtained under his name, and his SSN. This also means, that I cannot obtain a state drivers license. My question is - am I able to drive for the full six months that I will be here on just my Canadian Driver's License, and can I continue to do this as I extend the six month term (assuming of course when I cross the border and come back they see fit to continue to allow me a B2 status tied to his L1)?

Thanks so much!
J

Your B2 status implies that you still live in canad and have ahome there. You are a Cdn residnet, so your DL is istill good, based on your home addrsss.

You can drive on it as long as your keep it valid -- by maintininga Cdn adress -- a real one.

That is the drawback of domestic partner B2. All it is is exgtended tourist status.

My partner is a Canadian citizen here in the US on an F-1 visa for 1 year and I am an American citizen. We would like to obtain a domestic partnership here in NYC so that she may benefit from my job's medical insurance. Is this possible or must she be a permanent resident?

Whether she gets your company health insuarnce is more a matter of comapny policy.

If she is considered eligible by reason of your relationship, then it doesn't matter where she lives, or what her status in US is.

However, B2 status will not get her an SSN and I know some insurance companies will not cover dependants without an SSN.

So, yes, she can get a B2 co-habiting parner status, but that will not improve her ability to be covered on your company policy.
