Domicile Question..

Post Thu Jan 28, 2010 1:45 pm

Hi

I am a US citizen and about a year ago I became a permanent resident in Canada and living now in Quebec with my wife. She is a Canadian Citizen. We are considering moving to the US, and going through the whole immigration process, which I realize may take a year or two.

It appears that I (being the US citizen) need to be domiciled in the US in order to bring her to the US. If I have no home in the US anymore, how do people accomplish this? Do I need to buy a home in the US first? Do I need to break my ties to Canada and rent a house in the US? I prosume you cannot bring your wife to the US if you arent living there. What is the advise to me?

Thanks.

Typically, you need to be "planning" a return to US, such as a job contract, retirement , school enrollemnt. Something that indicates that you are going down to US to live.

Otherwise, there is little point applying for her GC if she is not planning to move there yet.
