DV lottery and future visas

Post Fri Sep 30, 2011 4:05 am

Hi

I'd like some advice please if anyone has experience with the "Green card lottery" or DV lottery.

I'm an Australian national and would like to apply as Primary applicant for the lottery this year, adding my husband (Canadian national) on the application. My husband has previously worked for many years in the US under a TN (I spent some time there under TD). We have lived in Australia just over 2 years now (he is here under an Australian Professional Visa and is an Australian Resident).

My question is this. Once I apply for the lottery, if my husband needs to enter the States for work will there be a problem with getting a new TN? Also, if we are unsuccessful in either being picked or passing interview (I know the chances are very slim for Australians to be allocated these lotteries but nothing ventured..etc ), will that mean that any future plans to enter the US under TN or E3 will be an issue due to our application for the lottery?

As much as the lottery seems appealing regardless of the long shot, if we are able to still periodically work in the States under other visas within guidelines then that is an option that we would still like to have. In all our visas over the past years we have never overstayed. Any serious advice would be warmly welcomed, as the DV lottery opens next week.

Many kind regards from Australia

Applying for the lottery should not impact getting TN... unless you actually win, in which case you need to start GC processs ... which would then make you ineligible for TN or even B2

The DV is such a long shot that DGHS does not consider this immigrant intent (otherwise, almost no one from DV eligible countries would be allowed into US as a tourist).

Thank you so much for your reply AGN :) We have been reading many websites tonight and your advice pretty much sums up what most of them say too. If the random chance of getting a shot at a DV lottery interview came up, we would process it via the Consulate here in Australia, which wouldn't affect a TN until the moment an I-485 is needed. The learning curve has been huge today!

Warm wishes and thanks again :)

If you process at consulate, you don't go the I-485 route.

You stay in OZ until it is processed.

Ok thank you.

Seems I should read more. Or maybe sleep - it's after midnight :)
