Canadian holders of H-1 visas who have reached or are soon to reach their maximum period of authorized stay (6 years), are in most cases required to reside one year abroad before returning to the U.S. in this visa category.

Canadians can avoid the foreign residency requirement by changing their H-1 visas to either TN-1, or E-2/E-1 Treaty Investor/trader visas.

With "Premium Processing", such changes can be accomplished within the United States in only 2 weeks.
