E2 visa stamping

Post Tue Aug 18, 2009 2:39 pm

Hi Everyone,
My husband is a canadian citizen and has been in the US on an E2 visa. Now, he would like to go to India and then return to US. Our lawyer says that my husband needs to get an E2 visa stamp in his passport. is that true, and do you guys have any information about it, like is this stamping done at a US consulate in canada or at the port of entry or departure.
Thanks a lot for your help

Yes, E is one of the few categories that requires a non-immigrant visa if you're a Canadian. He needs to apply abroad at a US consulate or embassy to get it (if his current one has expired), doesn't matter where although it will probably be more straightforward to do it in Canada. If he already has the status getting the visa should be straightforward, have a look at www.amcits.com

Presumably he already has gotten a visa in the past if he's in the US as E-2 unless he changed status to it, which USCIS usually hate doing with a passion for E applications so I assume he's familiar with the visa application process.

Thanks Steve,
he actually got his visa transferred from a J2 to E2 while in the US, so this will be his first time going to canada to get E2 stamped.

Very rare to change status to E, because of the treaty requirements.
