Educational restrictions with TN? H1?

Post Tue Aug 25, 2009 10:31 am

Hi.
Does anyone know if the TN allows the holder to register and study towards an MBA?

What about an H1?

Thanks

You can engage in study while in the US on TN-1 or H-1B, but it cannot be the principal focus of your stay.

So part time study while being employed full time identifies the principal focus... ?

It's a bit vague on TN-1 because there's no particular reason why you couldn't have two part-time jobs on TN-1. However on H-1B you must be employed full-time, which means you can study, but only while maintaining your full-time job.

Study is considered 'incidental' to onesTN/TD/H1/H4. Study, even meeting the definition of 'full-time' is fine, so long as you meet the requirements of your work status.
