Engagement to U.S. fiance off - what is next.....

Post Sat Nov 01, 2008 11:39 am

Hi there,

I am new to this forum (I am Canadian - born and raised) Just signed up today. I am very frightened and don't know what to do. I was engaged to my boyfriend (American) for over three years. We were suppose to have gotten married since last month (Oct.) but he has now suddenly decided that "we don't need a piece of paper to prove our love to each other"! He says that things are fine the way they are! (He must be out of his mind) I have been here in the U.S. for over 6 months now! The plan was that we would live here, get married, file for my status here.etc. Now I am heading towards becoming an illegal here and this scares me! I need to work! I don't want to live in the U.S. illegally. I have given up pretty much everything to be with him here and now he doesn't want to get married! So, I guess my question is this: Is there any way for me to file for a change in status for myself without his help? This is very frustrating for me. Any info would be greatly appreciated! Thanks.

No, unless one of your parents is a US citizen and living in the US to sponsor you for a green card, you are not eligible to stay and adjust status. You will have to leave and return to Canada.

Not really. There isn't any non-immigrant entry you can use as you don't have non-immigrant intent.

Don't overstay as it will make things complicated in the future.
Steve.

she's already overstayed. IMO, she should go home ASAP.

Hey Janr - are you still in the US? Does your boyfriend still refuse to get married? For an outsider, this is easy - just go back home and put your life back together. You've already sacrificed everything, and now he's asking you to risk losing your freedom? Nobody is worth this big of a risk.
