Establish Business in the US

Post Tue Apr 07, 2009 8:18 pm

I'd like to know what are the options I have in terms of immigrating to US or working in the US. I started music company in Canada, does record, promote and publish classical music on/offline. I want to be able to produce and record music in the States without any restrictions. Sometimes it requires hiring US musicians and individuals as necessary to produce recordings or I could bring my own Canadian staff to the States to do the job, but I don t necessarily need to live in the States.

I've been trying to find answer to fit my needs and thought E2 visa is something I might need. Thanks!

Yeah, sounds like E is the one, it's a non-immigrant visa. If the business gets large enough you can do EB-5 immigrant investor.

Have a read of: http://toronto.usconsulate.gov/content/ ... ment=evisa

You're allowed to "control" the investment on E but not be "self-employed", which seems to imply you need at least one employee. I have to say though I know people who've had E who basically were self-employed, as far as I can see it boils down to whether you say you're the president of the company or not. One guy who I know did it made his wife the person in "control" of it and got an EAD to actually do the work, because spouses of E-2 holders can get work authorization.

However I'd recommend you find a really good immigration consultant who has dealt with them before as E is by far the most complex non-immigrant classification, requires a business plan and so on.

Ive recently been approved on an E Visa.
You can PM me if you want and I can answer all your questions about it.

It was a loooong process but well worth it. I had to do consultations, hire an immigration lawyer, hire someone to put a business plan together for me and back and forth emails, faxes, phones calls for a few months.

In the end, it was well worth it though.

good luck
