Facing foreclosure

Canadian living in the US- married a US citizen 10 years ago, I was working for the same company until they closed in Feb, we are now facing foreclosure, this week will not be able to pay utilities, mortgage etc.we will end this marriage in divorce.my concerns are access to see my children, foreclosure, bankruptcy etc.as a Canadian do I return to my homeland?
What are international parental visitation laws?
Does my US bankruptcy/foreclosure follow me?
How is my credit rating in either country affected?

Lets face it the economy is bad everywhere and in my industry as auto parts suppliers come and go there is no security.so my dilemma, leave the US and start fresh in Canada?

I'm very sorry about your divorce and the loss of your job. Yes, the economy is bad all over the US. I live in North Carolina, small town that til recently has relied heavily on the furniture industry. Now there's only one plant left, the one I work at. And its really depressing.

Anyhow, the answer to your first question will really depend on the agreement made at your divorce and custody hearings. If youd decide to move back to Canada, just make sure your lawyer works in permission to take the kids over the border when its your turn for visitation.

Your credit rating in the US will certainly be affected. And it likely will be in Canada as well. A credit rating doesn't immediately "follow" you, however it is possible for Canadian credit bureaus to get information from American credit bureaus, its the same companies in both countries. You may need to speak with a financial advisor about it in Canada.

There's a treaty concerning parental rights, so I wouldn't worry about that. Unless of course you have to try and get it enforced, but Canada-US I wouldn't have thought is a problem, Canada-Iran on the other hand could be. If you've been there ten years I assume you're a US citizen anyway so it's largely academic as you can always enter the US at any time.

Your bankruptcy doesn't "follow" you exactly, but yes, it will probably negatively affect your credit rating in Canada because they use the same bureaus, generally.
