Filing 2009 US taxes

Post Thu Apr 01, 2010 12:47 am

I just returned from Arizona back to Canada after living and working there for 2 years. I worked for a US employer.
Do I complete a full time resident return in the US for Federal (1040) and State as I was in the US > 183 days? Or do I need to prorate the Itemized deductions for the time I spent in the states.
Does anyone one know which site to use for E filing if I am considered a part time residents. There are many softwares to accommodate full time residency. Much obliged!

You don't prorate deductions in US like in canada.

You should either file dual-status (reverse of when you arrived in US), or file full-year 1040, excluding your Cdn wages with form 2555.

For the state, you file only AZ-source income.
This site is a travel site and not best source for these topics:

thanks for the assistance.
This web site is so helpful to expats. Unfortunately, having just returned to Canada...do not intend to be an expat in the near future.

Hi all,
I am doing a postdoctoral fellowship in California. I have been there since September 2008 under a J-1 visa. Last year I filled both Canadian an US tax report. I am not sure if I needed to fill the Canadian one, some people told me otherwise. On the other hand, I read that it takes two years to become resident (for tax purpose only) in the US. Therefore I think that I have to fill a 1040NR, this is what I did last year. For next year I would Still fill a 1040NR and then a normal one (resident) and no more Canadians for the following years. Also, if I have to fill the Canadian tax report, do I subtract the taxes amount paid in the US? If I don’t, I will pay a lot of tax, which does not seem to make sense.
Finally, my girlfriend who came with me in California was working under a J-1 for 2009 and will now be under a TN for 2010 (she has a new job). Does the same rule apply? Is she going to restart the two years non resident?

Thank you
