Filing Tax with no relation to Canada

Post Fri Mar 19, 2010 2:32 pm

Hello everyone,

I am a Canadian that arrived to USA in August 2009, I am going to file my taxes in USA and don't know if I should file as a Non-Resident or Dual-status ( I fail Substantial presence test).

I have never worked or filed taxes in Canada as I lived most of my life in Spain. Can I still file dual-status? What do you think is the best option for me?

I would greatly appreciate any help.

Thank you

Typically, the best way to file in US is FULL-year 1040, reporting all world income for the year, and excluding any foreign wages earned before arriving.

You can do this, or you can file as non-resident (1040NR) if you did not meet SPT, or you can file dual-status (partial 1040).

I am a Los Angeles based Attorney and CPA who handles cross-border US-Canadian tax matters. Feel free to reach me if you need assistance with your US and/or Canadian tax filings.
