Hi all, very happy to find this website!

I have done hours, days, weeks worth of reading all over & still can't seem to find any answers regarding my 15 yr. old son being involved in the immigration process to the US.

My hunnie & I got married on Aug 1st, 2007 in California, submitted the I-130 while I was still there (we will end up going the CR-1 route as lately it sounds faster) but no where can I find ANY information at all if there should be any forms submitted for my son! Very frustrating as there's so many single parents out there but no info about this issue! The gal from USCIS told my husband that we should have submitted a separate I-130 for my son but I'm reading conflicting information. One site says that since he's under 16 yrs old, he would be included in my application but yet since he's over the age of 14, he still needs to be interviewed if need be.

Can someone PLEASE shed some light on the issue? GREATLY appreciated and wishing everyone well that is going thru the same lonliness & waiting!

PS.Please tell me what it means when people on Visa Journey have their timeline on their posts and "touched" is a part of it.sorry for my ignorance!

Your husband will need to send in an I-130 petition for your son, otherwise he'll end up waiting in Canada long after yours is done. If you have the NOA letter from USCIS on yours, he should include a photocopy of that with the one for your son, with a cover letter explaining the situation and *maybe* USCIS will match them up. But don't hold your breath.

On Visa Journey, "touched" means that the persons on-line profile at USCIS has been updated. Usually an update on your USCIS profile just means that someone there "touched" your file. Like moved it from one pile to another, or spilled their coffee on it, or pulled it out of the circular file where it was "accidently" dropped a few days ago. Sometimes it actually mean that someone is working on your file. But not very often. Wink

I just found this when I did a search for CR-2:
If your relative qualifies, "separate petitions are not required for his or her unmarried children under 21 years of age." My husband called USCIS & they told him the same as what you said Reba, this is posted on a legal forum...and from what I've read, employees at USCIS Customer Service, don't always have the correct answers...

Please disregard my last post as I was reading the directions yet once again on filling out the I-130. It states in there as to who has to file and yes, he definitely needs the I-130. I will be doing exactly what you recommended Reba, I'm sure in the end it will all work out. Thanks again!

Among those of us more experienced with USCIS, we call the 1-800 line the "mis-information line". If you call 5 times you'll get 5 different answers, they really don't know much if its not on their scripts.
