Getting my spouse on TD visa

Hello,

sorry if this question has already been answered.

I'm currently working on a TN visa in the US for the past 3 years, and am wondering if I can get my spouse who is neither a US nor a Canadian citizen on a TD visa to the US? Furthermore, can we apply for this TD visa just at the airport when travelling into the US, like I do for my TN or do we need to go to an Embassy?

In addition to that question, I know being on a TD means that you can not work in the US but you can study full time? Does any one know if my in-state residency would apply to my spouse to help on the cost of tuition?

Since your spouse is non-Canadian, your spouse will first have to obtain a TD non-immigrant visa from a U.S. Consulate or Embassy before seeking admission.

Correct, you may not work or generate income on a TD but you may study full or part-time.

In state tuition usually does not apply for TD or TN visa holders. But that all depends on where you live. The school I attended considered students on a TN or TD out of state. This is in Florida so depending on what state you reside, things may be different.

May also depend on the college. Some around here have different rules. Check them all out whereever you're going to be living.

She must have a TD visa, apply at the consulate, the instructions are on here: www.amcits.com in essence the application is identical to a regular B-1/2 visitor visa except she must have proof of your TN-1 status when she applies, i.e. a copy of your I-94 and something to prove you're married like the marriage certificate. This makes it tricky of course because you've got to get the TN-1 first.

She can study full-time on TD, but it cannot be the primary focus of her stay, which doesn't mean a hell of a lot on TD, just means you must stay on TN-1 essentially which is obvious. The reason it doesn't mean a hell of a lot is because she cannot get in-state tuition rates on TD, unless someone in the admissions office screws up. Different States have slightly different rules but I can't think of any that consider TD to be resident (although there might be).

Obviously check with the college/university.

Some give TD (and H4 etc) residency status after one year of residence in the state.
