Giving up Green Card less than one year after obtaining

If you want to give up your status in the US, just move back home and turn in your Green Card to USCIS. I think you mail it to the London, Kentucky office. Not sure you can just hand it over at POE or not.

You'd still have to file a US tax return for 2009 year, but once that one is done, and you've given up your status, you won't have to file with the IRS again.

According to the US Consulate Toronto website, you would need to file Form I-407 with the consulate (not necessarily Toronto) after you leave the US. The green card is sent to/brought to the consulate, not KY. Not clear whether it is better to do this in person or by mail.

All I can say is, remember to file that form because my uncle didn't and had a very unpleasant experience with the IRS afterward.

Well what I would say before embarking on this (given that getting LPR status again will be very hard) is to make sure you're 100% correct on the tax situation because the tax treaty changed last year so that RRSPs are considered to be IRAs under US tax law. Plus the US only assesses capital gains tax now from the date of entry of Canadian citizens on their assets, not from the date the asset was acquired.

This substantially reduces the tax burden on Canadians moving to the US, however it doesn't get you out of departure tax which is the usual way Canada stops people from leaving. Especially if you've got a CCPC with anything significant in it.

just to clarify, RRSPs have always been treated by IRS as pension funds, sheltered so long as one files the correct form/statement. Nothing changed in the current treaty round.
