got job sponsor, for job that not on nafta or tn

Hi, I am a canadian citizen. and my best friend just started a new website in fetish/adult entertainment. she wants to sponsor me, to move to the states. so I can help work on her webpage. it is a members site, that makes around $50,000 year. and it is only her, and me that work on the site. I help with uploading videos, graphics etc.

I learned how to do computers, and photo stuff on my own without a college degree. I looked under TN and NAFTA and HB1 visas, to see if this type of business is listed under one of those. But I couldnt see any category for this type of work. If she sponsors me, and we take paperwork to the US embassy in Canada. Can I get it approved, so I can move to the US to help her work on the website? I cant do all the work on the site, from another country. I need to be in US to work properly on the site. Can I get some kind of work visa for this type of work, because I have someone who is willing to sponsor me.

You wouldn't qualify for a TN since that job is not on the NAFTA professional job series list. You probably wouldn't qualify for an H-1B either since you need to be applying for a professional job that requires at least a bachelor's degree (or significant years of experience).

hi acolotl. thanks for the reply. yes I loooked at NAFTA and TN and H1B visas, and it doesnt seem I would get any of these visas for the type of job sponsor I have.

Does anyone know if I qualify for any other type of visa? My sponsor that owns the new website, things that if she sponsors me, to work on the site. I can get visa this way, and when I was younger 4 or 5 years ago. I was told at the US Embassy, I need a job sponsor to write me a letter to get working papers so I can work in US.

So does it even matter that, the job type offer I have isnt on TN or NAFTA. I can still get visa because I am being sponsored?

The site is new, and its only the 2 of us who do it, my sponsor and me. So we really think this site in a year or two will be making atleast 100k a year, which is atleast 50k between the 2 of us.

Also I invested some money in the site too, does this help at all? I heard to invest in a company in US, you need to spend atleast 100k is this true? We have not spent nearly that much on the website. But it is a private business. So what kind of visa can i get for this, and is a letter from my sponsor saying, She wants to hire me to work with her in US for the site good enough? And I can take this to US embassy or something in canada, to get it processed, for howeverl ong it takes like 8-10 months?

I went on the other links on this site, but cant find any info about this type of work.

There's no work permit category for this, not without a degree anyway. You might possibly be able to get E-2 but it requires a "substantial investment" as well as a comprehensive business plan and so on. What "substantial investment" means is vague but generally the advice is that it means $50,000 or more.

E2 is a business owner visa? If my sponsor has already invested 50,000 in the site, and wants to sponsor me would that be allowed?

Also I have heard from people, that as long as You have a job sponsor, and someone willing to sponsor you for work. And a letter is written by the employer, that US embassy will accept it for some type of work permit or visa, since I am canadian citizen , and born in Canada. is this true? I do not understand either, why only TN OR NAFTA jobs would be the only ones? Because this is a pretty good job for the website we have, and it will pay more than most of TN jobs anyway.

I did go to the US embassy, about 4 years ago when I was a student. To ask about working in US. they told me You need a job sponsor and letter from the sponsor. they never told me it must be only for NAFTA OR TN jobs.

is it not true that as long as You have a job sponsor and employer, and maybe some sponsor money? then You will be allowed to get some type of visa? Does anyone know if I should retry the Embassy to ask now? As long as employer want to sponsor me for work, that is allowed some kind of visa?

You need a lot more than $50,000 of investments in order to be qualified under the E5 category. You're looking at close to 1 million dollars in order for you to file under this category.

Unless you're able to provide years of experience in lieu of a 4 year BA or BS degree, obtaining a work visa for what you want will be difficult.

Your friend could petition you under the EB 3 "unskilled" or "skilled" category. The difficulty with this visa is that it takes years to obtain and a Labor Certification (PERM) would need to be done before your friend petitions for you.

Being a Canadian has got nothing to do with anything. The process will be the same as long as you're not a US citizen or LPR.

You could also go in as an international student and obtain a Bachelors degree in the field you plan to work in. Close to graduation you would apply for OPT then your friend could try and obtain an H1B for you. Of course this too would take some time but not as much as the it would take for him/her to file for you under the EB3 category

We're not talking about EB-5, that's immigrant investor, E-2 is treaty investor which is a non-immigrant category. E-2 doesn't require the same sort of money as EB-5. E-2 is valid for two years and can be renewed indefinitely provided the circumstances remain the same.

E-2 is by far the most complex non-immigrant category to apply for because each application is significantly different, really the only way to get a good answer to any questions about it is to find an immigration consultant who helps with them on a regular basis. Even if you find someone who has E-2, your situation is likely to be significantly different.

But basically you need proof of a significant investment, comprehensive business plan and many, many other things that requires a hell of a lot of form filling.

Only for TN-1, and you don't need to involve the consulate for most non-immigrant categories if you're a Canadian citizen as you don't need a visa per se. E-2 is however one of the few exceptions because it is so complex and there is a possibility you could stay endlessly, so they require a visa for E.

It's very hard to get into the US to work for any job that doesn't require a bachelor's or equivalent. There are a few exceptions, the main one is L-1B but that's not relevant to your situation. For H-1B you can substitute 12 years of relevant experience.

I guess whichever way you put it, it will be difficult to obtain a visa considering the circumstances. I would say get all of your paperwork together including any business documents and head over to see an attourney. You never know, things may work out in your favour if your case is handled properly and you receive proper advice.

The E2 category I forgot to mention is also an investment visa.
