Green Card received, but now want to move back to Canada

Post Tue Jul 05, 2011 7:53 am

Hi!
I'm new to this forum, but found some very helpful information here.

So I recently received my Green Card after many years of paperwork. I was sponsored here on a K-1 Visa and married my husband in 2008. Well, the marriage is now kaput and I've filed for divorce and will be moving back to Canada shortly after my divorce paperwork is put through.

My job would like to keep me on for a month or two as a contractor (I would work from home in Canada), and I still have to return to the U.S. for my final judgement for the divorce and to do a few things before I'm officially done with my company (after the contract is up).

Any advice as to what I should do in regards to my Green Card? Do I file a I-407? If so, when do I do this, since I still need to return to the U.S. a few more times and am also working remotely?

Will this be an issue when I want to travel for leisure in the U.S. if I give up my Green Card?

It sucks after doing all that paperwork myself and paying so much money, that I have to give it up, but my family and friends live in Canada and I don't see myself moving around in the U.S. Being away from my friends and fam was too hard already.

Suggestions and advice would be greatly appreciated!!

You will eventually be asked/told to give it up by border officers, so prepare yourself to do this voluntarily.

I would at least file a Re-entry permit (i-131) which covers you for the next 2 years regardless of where you live. I would not rescind the GC until your divorce etc is finalized.

If you give up your GC on your own, you will have no trouble re-entering as a tiurist. It's those who don't give up their GC who get a surprise one time, when they are temporarily refused entry and GC confiscation process started becuase they no longer qualify.
