Green card: TN income used in place of affidavit of support?

Green card: TN income used in place of affidavit of support?

Hi all,

I'm applying for a Green Card by marriage; I got married last year and my wife and I recently had a baby, so she's staying at home right now and I'm working. Currently I have TN status--can I use this income in place of an affidavit of support, since my wife has no income? I realize that my TN status is temporary, but can I, for example, get a letter from my employer indicating that they intend to continue to keep me as an employee?

Unfortunately, not likely. Because your TN status is temporary, if the TN expires before the green card is completed, it is likely you may become unemployed at some point.

I'd suggest you find a co-sponsor, like a family member or friend or co-worker.

I don't expect to be unemployed at some point--my current TN status expires in mid-April 2009. I'm filing an I-765 (work authorization) and an I-131 (travel authorization) at the same time that I apply for the Green Card, which I understand take about 3 months to process, so I presume that, once these are processed, I can then continue to work for my present employer once my TN status expires.

HOnestly, I still don't think they'd accept the affidavit of support income to be soley that of the beneificary and not the sponsor. Just my opinion, from reading several years on immigration message boards. Unless you have assets sufficient to include on the affidavit, it is unlikely that they will consider your income as the primary income.
