Green Card/TN

Post Mon Dec 12, 2011 12:03 pm

Hi,
My mother is a US citizen and she has applied for my green card.
Would it be possible for me to work in the US on a TN?
Thanks
Monty

It depends on how far along the GC process initaiteed by your mother is. If she has file I-130 for you, you technically could be denied TN due to immigrant intent. It might not happen on your first TN (at the border) but could come up later at renewal time.

You do realize that it will take about 7-10 years to get GC thru your mother, so if you are turned down for TN for this reason, you might just want to cancel this fruitless I-130, and then re-try TN a few months later, and then try to get GC thru employment.

Because it is unlikely that CBP will have a tie the I-130 submitted by your mother to you.

Later, especially if you renew your TN by mail, but perhaps also at the border, you will have a file, which may include info on I-130. And the I-129 that you submit if you renew by mail has a question that you MUST answer YES to, if anyone has files an I-130 or I-140 for you.
