H1A/H1B - Registered Nurses

Post Sun Oct 04, 2009 12:33 pm

All question(s) related to Canadian Citizen worked on TN previsouly before going for H1a/H1b:

1. Does H1A/H1B requires to fillout DS-156/157 when facing interview at any Port of Entry?
2. Does employer letter attention to Consulate will be acceptable at any Port of Entry? or needs to be changed by employer prior to interview date?
3. Does any Port of Entry in NY accepts Cash and Credit cards as H1b processing fees?
4. Which Port of Entry in NY accepts H1b processing applications?

Thanks in advance

As a Cdn, you don't have any dealings with US consulate on any of this.

Employer files I-129 for H1 with CIS, not port of entry.

Once the I-129 is approved, then you enter US with this approval.

H-1A doesn't exist anymore, it was scrapped a decade or so ago. H-1C is intended for nurses and is virtually impossible to get because of the quota. Nurses can't get H-1B except in limited situations, that's what H-1C was intended for.

By far the best option is TN-1, no idea why you want to do it any other way. It's subject to far less restrictions than H-1B or H-1C. If you're doing it because it's "dual-status" and you want your employer to sponsor you for LPR status, that can be done from TN-1, it's just a bit more tricky. Just make sure your TN-1 is valid for a year or so before you file for AOS when the I-140 is approved.

As I'm sure you're aware, this is all done at the POE for TN-1.
Steve.
