H1B Stamping if a Canadian Citizen?

Post Wed Sep 17, 2008 1:15 pm

Hello,

I have been approved for an H1B visa. The company I work for told me to call the US embassy in Canada and arrange for a stamping interview. When I contacted the embassy they told me they don't stamp H1B visas into passports of Canadians. They said just go to a port of entry with my approval notice. Is this true? The company seems to think I still need an interview.

No you don't need a visa. I thought you did if you were H and were a Canadian citizen, learn something new every day.

well this is actually what they say on their Canada consulate website. "Canadian citizens who have been approved for temporary employment in the H, L, O, P, Q, or R nonimmigrant categories, should proceed to Customs and Border Protection at a port of entry with a Notice of Approval Form I-797." So I guess that's clear enough. My only worry is that the customs officers don't always know the rules.lol

I think you are somewhat correct that some immigration officers may not know the rules perfectly. I came down on an L visa and although I lived in Winnipeg, our lawyer at the time highly recommended obtaining the visa in Buffalo NY. At that time, they had nothing but problems with US immigration officers at the Winnipeg airport. It was so bad for a while, even if you were crossing just for business meetings with US clients we would fly via Toronto and cross there.

I suspect it was probably one individual and probably someone instructing the rest to follow his or her lead because we now regularly cross in Winnipeg airport and we don’t have any problems.

How on Earth would a Canadian get a Q entry? Bizarre.

Good question Steve. Maybe it's more for the French Canadians.
