H4 for spouse who is not moving with me?

Hi,

I am moving to the US on an H1-B Visa. My husband is eligible for an H4 as my dependent. BUT, he will be staying in Canada for a year to finish his degree. Can/should he still apply for the H4 even though he will be living/working in Canada?

Yes, it will be valid for the same length as your H1B. My wife did this in 2010 and stayed in Canada for 6 months before coming down permanently. It makes travel across the border MUCH simpler since there is no need for your spouse to demonstrate they do not intend to immigrate.

Nor have to prove that she has a Cdn residence.
