HELP -Canadian girl, looking to move to the USA temporarily

Post Sat Oct 18, 2008 7:52 pm

Hi,

I've been searching all over the internet about work visa's, work permits, EAD's it's giving me a massive headache.

I'm dating a US citizen for awhile now, I understand that there's nothing really he can do to help me, HOWEVER I DO have many family members living in the USA, would it be easier for me to find work and live in the USA, if they know that I have family in the states?

I do not have my bachelors/degree so I'm aware that I probably won't get sponsored by US employers, what are my options aside from marrying a US citizen, or applying for a green card at this moment because I know green card is a long process.

To summarize it, am I able to get a work permit/visa if i move to the states temporarily and would it be easy for me to get one having family in the US?

THANKS! Much appreciated!

Unless you are qualified for some sort of job that an employer would sponsor you for, no you can't get a work permit in the US. And unless your family there are citizens, and is your mother or father, they can't sponsor you, so they're no help either unfortunately.

Well, my parents aren't US Citizens, but majority of my family members are all in the USA(are US Citizens) and London England/Europe, We're the only ones in Canada, which is why I wanted to know if it'd be easier for me to get a temporary work permit or EAD or somehow get dual citizenship?

I'm afraid only parents could sponsor you for permanent residency, not other relatives.

Unless you qualify for some sort of NAFTA or H visa, you wouldn't be able to go there to work either.

Perhaps a student visa of some sort to continue your education and get a degree? Some student visas will allow you to work part time on campus.

Brother/sister can sponsor you but it takes ages. Any sort of family sponsorship takes ages but you will be old and grey if you go for fourth preference by the time it is approved.

These instructions explain family sponsorship: http://www.uscis.gov/files/form/I-130instr.pdf

This is the current visa bulletin that gives priority dates: http://travel.state.gov/visa/frvi/bulle ... _4371.html

Fourth preference is currently at November 1997, that doesn't necessarily mean you will wait 11 years (if you filed today) as they may process more applications in a month than simply going by calendar year and there's no way of knowing exactly how many people will apply in future years in the higher categories with higher preferences in the quota, but I'd be amazed if anyone got it in less than nine years.
Steve.
