Help/got a weird message from the immigration lawyer (H1B)

Help/got a weird message from the immigration lawyer (H1B)

Hey guys, me again. I am waiting for my H1B to be processed and just got a weird e-mail from the immigration lawyer. They said USCIS called and wants to know what consulate I want to go to for stamping my H1B? they put "ontario, canada" on the app. I'm thinking this is too vague and USCIS wants clarification as to the border crossing not consulate. I am Canadian...can't I just go to a border crossing for H1B?

Tell him you are Cdn and not subject to consular stamping, and to change the answer to PFI or POE (its Part 4). Tell him which POE you are most likely to cross at. Your lawyer should have checked PFI or POE instead of Consulate. Dumb, but typical.


And once you are approved, you can then cross at any POE/PFI, by the way.

Ok I just emailed the law firm this info. It's because this staffing firm and law firm they use are used to bringing teachers over from India and a few other places, to the US - the fact that I am Canadian is a new thing for them I think they may have a newbie lawyer on my case too (there were a few other glitches but I digress...) THANKS!

By the way, Atlanta rocks, except for the snow that seems to have followed me here!

If you are in the states legally right now, you don't even have to go to the border, your H1 application should have asked for H1 approval and change of status simultaneously.

Oh well, make sure you are reimbursed for the trip to the border.

Yes, I was in Canada when the H process started, thinking that the lawyer and staffing firm would have submitted ALL the proper paperwork under premium processing, and that I would have had my H1B approved by January 1st (when I knew we had to come down for my husbands job anyway). But they waited until USCIS made a RFE asking for a letter of eligibility from the state, proving I was eligible for a teacher's license. Why the law firm did not have all that ready to go when they had MORE than enough time, I do not understand. ANYHOO, I just got an e-mail that USCIS has now approved the H1B!! Yeah! I don't know how long it will take to get the paperwork to me or even if it goes directly to me or to the lawyer's first but either way, yes, it's going to cost me the airfare and no, they are not going to pay for it :x
