Help needed... ancestry visa / spousal visa?

Post Sun Aug 17, 2008 10:58 pm

Hi guys,

I am a Cdn living in the UK with my British born boyfriend and on an ancestry visa (I have been for a little over a year now) and we are planning on getting married in the next year or two. I am trying to find information as to what the process would be for this type of situation as I'm already granted to live in the UK for up to 5 years with the ancestry visa. Would I still have to go back to Canada and apply for a fiance visa and then get a spousal visa? Or would I just have to apply for the spousal visa? It's seems a bit odd to me and I can't find any info that would pertain to something like this. So if anyone can help shed some light on this, or send me to websites that may cover this, I'd greatly appreciate it!

Cheers,
Hollie

If you already have a visa (ancestry) you do not have to apply for another one.

Okay, What about after we get married, I'll have to change my visa to a spousal visa won't I?

Thanks.

if you get married with your British boyfriend you don't have to get a spouse visa , you are already legal here with your ancestry visa.

If you can stay here for 5 years, I assume at the end of the 5 years you can apply to indefinate leave to remain?

If yes then there is no point to apply to the spouse visa.

For example someone that would be on a Working holiday maker visa or a student visa would get an advantage to apply for the spouse visa because these type of visa are temporary and doesn't give them all the rights that a spouse visa would (for example for the WHV they can only work 1 year max and sutdents can only work part-time, the whv is for 2 years max and they have to return to Canada after, the student visa is only for the length of their study).

hope this helps

Okay, that does help! I was wondering if it would make a difference for if I had to switch visa's. And like you said with an Ancestry visa I do have all the rights to live and work as the other, spousal visa so if there isn't any legal points to having the spousal then I suppose I won't bother. That's awesome, good news for the bank account. or well until I apply for my indefinate leave to remain! I appreciate your help. Thanks a bunch :)

Hollie
I too am in this situation, but left it too late, and the immigration at
at the airport said because my ancestry visa was expired
It was a 90% chance i will not get it if i apply. don't leave it too late.
Now we have to get married and i have to go back to Canada
to apply for a spousal. what a mess. the post delayed the birth certs etc.
