HELP! Suspicious Looking and Constantly Hassled

Post Tue Oct 25, 2011 11:25 pm

I am constantly searched by border patrol.
Over ten years ago I was denied entry to the US because without my knowledge I had a warrant out for my arrest (due to identity theft). Luckily I was not charged with any crime and was able to clear the confusion.
A year later I was being hassled again because my name and stats corresponded to a wanted felon (I was told this by a helpful officer who said there was nothing I could do but put up with this).

Since a travel to the US for extended periods (5-6 months) for vacationing and visiting friends. I have growing trouble crossing. My ability to travel as much as I want is also my downfall: I am a self-employed free-lance photographer and translator (so I don't have any pay stubs everything is done online (I do mostly photo editing) and all I need is my computer), I do not own a house, have no husband or kids… so I understand their concern that I might stay or work in the USA. I have a fair amount of savings and prefer intense work periods and time off in the winter and head south but I’m too young to be a snowbird. I just left my apartment of 13yrs to return to live my parents to help them out financially. This might complicate things even more for me (no more utility bills in my name).

So when they ask if I have ever been denied access to the US or have had complications well... I tell them my story which makes me look like a trouble maker hence more search.
Is there a way to know what they "see" when they scan my passport? I do not wish to give unnecessary info that complicates things for me but also I do not want to appear as if I am lying. Also they do not seem to “like” my non-traditional job and I debate telling them that all I need is my computer. My income is wired to me as Canadian in Canada?!
What can I do to "prove" I will not stay?! I wish the fact that I have been going to the US regularly for 10yrs is an indication that I love the country and if I wished to live there I would have done that already! But I refrain from saying this to border patrol! Any help appreciated. Thank You!
BTW: I only look suspicious on paper! :)

Anyone who is denied once, will always be scrutinized; that is the reality.

The fact that you spend so much time in US, and don't have employment to go back to, makes you an automatic risk.

The work you descibe makes you a target as well, since I'll bet you've logged on to your computer and worked while physically in US, and the officers know this.

So, the best way to prove that you will not stay, is to leave US more frequently, ie. take shorter trips... or settle down.

You do indeed look suspicious... or were you making a racist comment.

Thank you Agnelson for your help.
It was not a racist comment at all. I was only suggesting that when crossing I am casually well-dressed, well-spoken, polite, forth-coming and carry with me nothing that looks suspicious ie: cameras, business cards or info on other artists etc... so nothing to indicate I will try to find work or that I'm a up to no good (?!)

So this entry denial would still be in the system even after 10yrs? Is there a way to get rid of it or say that any problems I've had relating to my name where due to theft/name confusion?

Also is there a way we can "know" what's in my passport info (when the scan)? And search this info without creating even more suspicion?

Another question: How can it be illegal to work off one's computer in the US if the income is not from the US? What about novelists that spend years traveling around and writing? Does one need a special Visa? And what would that be given that there is no income until the book is picked up by an editor?

Your profile is getting you scrutinized for 4 reasons. The denial of course, the lack of ties, the risk of unauthorized work, and the length of stay. So I wouldn't spend too much effort trying to remove the denial if you could. You can make a freedom of infromation (FOIA)request to ask DHS for what they have on file for you and take it from there.

Writers can write, photogs can take photos. But the fact you are asking about doing work in US probably means that you have (taking an order (not illegal), finishing the work (probably not illegal) , and sending it to the client (probably illegal)) while in US. Not a big deal, but shows that presenting yourself in front of the inspector with no 'tools' doesn't really mean anything -- and they know that -- regardless of what you look like.

In the end though, they are not denying you entry (no one has right to enter), they are merely investigating (no one has the right not to be investigated), which is completely in their job description. You've got the time, so do they.
