HELP!!!! VISA CONFUSION FOR LAW SCHOOL APPS!

Hi all,

I'm seriously considering studying in the US for law school. However, after starting my applications, I am a bit confused as to the process regarding Visas. Here a breakdown of my confusion:

1. If accepted, the school will issue a form (I-20) which I can use at the border/customs to enter into the US. At the border/customs they will issue a stamp which will grant me a status equivalent to F-1. I do not need to approach a consulate because I am a Canadian citizen. Is this correct so far?

2. It is to my understanding that F-1 Visa holders cannot study part-time in the US. Is this also true for Canadians? Or does our special status give us different conditions.

3. Many applications are asking for my Visa Status. I do not currently hold a Visa as I am attending undergrad here in Canada. I am assuming they are asking what class I would fall under. Would I indicate F-1 or something else as a Canadian does not have a conventional F-1?

Any help would be greatly appreciated! Thanks!

1. Yes you are correct. You will apply for F-1 status at the POE or pre-flight inspection at the airport.

2. Canadians do not have a special status in anything where granting visas are concerned. This is a big misconception that we fail to realize. The TN visa is the only thing special that we're able to obtain under our treaty with the U.S. and we share that priviledge with Mexican Citizens. Canadians on F-1 status along with all other countries must be studying full-time (12 credits per semester) in order to maintain that status. The rules apply to all foreigners. Part time study is for those students who are close to graduating or if there are other underlying circumstances.

3. Assuming they are asking what you're future status will be upon entry, you will check off F-1 visa..etc You might want to let the school know that Canadian Citizens do not require consular processing for an F-1 and that a physical visa is not required by DHS.

Prior to getting your F1, you status is N/A, since you are in Canada. That question is for those already in US on another valid status.

1. yep
2. well, basically you'd be in B as a visitor, and you're allowed to engage in part-time study which is a bit vague, the example CBP give in one of their pamphlets is someone who attends a cooking course while on vacation.
3. when you get it, it's F-1, assuming that's what you're going for. Might be J-1 or M-1 but usually not for a law degree.
