Hi everyone,

Firstly, I want to thank everyone for contributing to the site; a lot of useful information.

Although I have learned a fair bit I have a question that is a bit more specific:

I am expecting an offer of employment from a company in the United States this week (permanant employment). They have told me that they will file me as a TN visa and later then apply for an H1B once I am in the country.

My concerns are as follows:

1. I have a CGA, Accountant, so I am on the NAFTA list; although my job title will be senior business analyst? Will this cause a problem?

2. My employment is permanant, but the TN Visa is for 1 year, I realize I can renew every year but does my employment letter have to state that its only for 1 year or can it say it is a permanant, full time position?

3. Intent -- My intent is not to move to the states permanantly as my parents and my place is in Canada but my intent much later in life might be moving to the states, MIGHT! . how do I deal with this during the interview?

4. Is there anything else that I need to take into consideeration when I look at the offer letter? . I am certain the company sponsoring me is fairly adept but I just want to make sure.

Please help.

Thank you.

A business analyst is an accountant. And the title does not control, the job duties control.

2. My employment is permanant, but the TN visa is for 1 year, I realize I can renew every year but does my employment letter have to state that its only for 1 year or can it say it is a permanant, full time position?

It can say permanent, full time, but it should also indicate that the employer agrees that the employment will be one year at a time.

3. Intent -- My intent is not to move to the states permanantly as my parents and my place is in Canada but my intent much later in life might be moving to the states, MIGHT! . how do I deal with this during the interview?

You have a preconceived intent to immigrate, which is fine, as long as your immediate intent is to stay temporarily.

4. Is there anything else that I need to take into consideeration when I look at the offer letter? . I am certain the company sponsoring me is fairly adept but I just want to make sure.

Your application has some complex elements, so an experienced immigration lawyer should be involved.

I'd be happy to speak with you about this.
