Here is a tough one to answer - temp stay/work in US

Hiya

This is an odd story for which I am desperate to get advice.

I am currently a 35 yr old Canuck in the US as a 'tourist' with my US girlfriend- so the 6 month clock is now ticking.

My girlfriend was posted to the US with the US government for the next 16 months. After which she (and so, we) move to another country.

I have no intention to take up permanent residence but wish to stay in the US until summer 08 with her. Work would be nice too.

I have a Masters of Arts degree and have 10 years experience in United Nations type peacekeeping missions with various international organisations. One problem is that I dont seem to fit under any listed profession on the TN visa list.

I dont really need to work but would like to keep myself busy. (I have enough funds to relax a few years.but not enough for an investors visa or to pay university tuition for a student visa .unless you know a mickey mouse school in NY.)

I am even willing to volunteer/intern/learn a new profession/do professional work/background work in movies even. Is there a visa for interns?

Can anyone suggest some options for visas so i can become a temporary resident and/or employee given the fact that I only plan to be here for about 1 year so paperwork would need to be done ASAP -meaning under 2 months?


p.s (k visa also not an option as US government needs about 1 year to check me, given the girlfriends job)

One could get married then adjust status (AOS), of course one has to come into the USA. without the intention of staying. I don't see why ur wifes job would take you longer to get a K visa. My wife works for the USA goverment (I wont say anymore)and it did not take us any longer. Depending on ur wifes job security clearance/which govt organization, she may have to get a waiver for you! Sometimes they will issue one, sometimes not (but thats up tour wifes employer, nothing to do with the visa process!)
I do not know much about the TN visas, well nothing actually. As I stated above, you could AOS if you got married. During thattime , you would not be able to leave the USA (may get denied entry to the USA) and I'mnot sure you could work until you received a EAD (work authorization) Best of luck

Is your girlfriend a US citizen? I kind of get the feeling she's not by your post, but I could be wrong.

If she is not a US citizen, then the K1 fiance visa is not an option. It is only available to US citizen petitioners. As is the K3 spousal visa, and Adjustment of Status based on marriage.

Unfortunately, there are not many options open to Canadians who wish to work in the US unless they are eligible for a TN. There is no temporary work permit, or working holiday maker visa in the US as there is for other countries (ex: UK). Movie Set Intern is not included in the TN list ;)

Yes she is a US citizen.

No we are not married.


We have no intention to marry at the moment. the time it would take to get the k1, plus security clearance due to her job would probably amount to the same time in which i want to stay in the US (1 year). Besides the cost of getting married (and the divorces are too common these days). Common law is so much easier.

Any other suggestions from anyone?

Common-law is not recognized by the US federal government, so is not an option for marriage based visa petitions or applications.

so unles you're eligible for a TN visa, and you can find an employer willing to sponsor you there are no options. You could apply for an extension to your visitor status, but that does not give you employment authorization.
