How do i return?

Post Thu Oct 07, 2010 7:29 am

Hi, I'm new here and need some advice. Basically I spent 6 years living in Canada, whilst my ex was on a work visa,we are both British citzens,(but I have recently found out that my mothers father's father was Canadian,we dont have any paperwork as my mum was originally adopted) we didnt go ahead with our citzenship(my ex's work were willing to pay for it,but they had to many restrictions on it) we left near the end of 2000,and moved back to UK, whilst in Canada,my son was born, and is a Canadian citzen, which is fine, we however had Perm-Resident status, and we were issued with a returning-residents visa as we were undecided at that time on what to do. We have been back in the Uk, for 9 years now,and I really want to return to Canada with my children, I'm not sure if I still have my Perm-Resident status anymore,as the Uk high commision site states I might have. I'm really confused as I really hope i havnt left it to late! and I also wanted to know as my son is a Canadian citzen, and he is disabled(meaning he would need a chaporone) if he wants to go to Canada, how easy is it to return with a child who is Canadian, but the parent is not? sorry for this but it's really eating me up!!

Just to let you knowe that it was unlikely that you were a Cdn citizen based on what you said (although, you could have naturalised based on being a PR long enough). You no lnger have PR status either, unless you were married to or working for a Cdn.

In any event, you now have to re-start the immigration process. I do not believe you get points for having a Cdn citizen child.

Thanks for your information. I have been in contact with the london embassy, and they have basically replied and said that my PR status is intact, and that it was re-instated regarding my son, who has a disability and needs assistance to travel to Canada. I'm really pleased as I really thought i had no chance. The decision is based on our family cirumstances as we have meet our basic residence. and the fact that on commpasionate grouds our son will always need help throughout his life, they couldnt deny him re-entery to Canada,as he is a citizen with special needs.and I'm his carer 24/7 I'm so pleased!! cant wait to get on the plane..x :)

Good for you. Thanks for the update. I was unaware that having a cdn child extends PR status indefinitely.

The issue about returning with a disabled child is -- I believe -- a separate, humanitarian issue.

Of course, if you still have PR status, Canada cannot prevent you from re-entering, so their "decision" to let you back into Canada was not humanitarian -- it was the law. same for your Cdn citizen son.
