How soon can I renew my TN visa?

Wow, this forum is awesome. so much useful information.

Here's my background. I am a Canadian citizen in the US on a TN visa, that expires end April 2008. I am married to a GC holder, who will get his US citizenship this year. There is some potential I will face job issues (i.e lose job) in the near future.

1) Can I go back to Canada and renew my TN visa in Jan/Feb? or is there some timeframe before the visa expires when I should renew the visa?

2) What happens if I lose my job but still have a valid TN visa (say till Jan 2009, if I renew in Jan 2008)?

3) Is it possible for me to apply for a Green Card through my husband when he gets his US citizenship this year (even though I will be on a TN visa then)?

You can renew the TN up to 6 months before it expires. I would suggest you file with USCIS and not go to the border, as they could refuse to admit you in TN status again based on your marriage to a USC.[/b]

Once you lose your job, the TN is invalid and you would immediately need to depart the U.S.

3) Is it possible for me to apply for a Green Card through my husband when he gets his US citizenship this year (even though I will be on a TN visa then)?

Yes, you can do a TN to green card. This has been discussed in several prior posts.

Thanks for your response Mr. Rizzo.

I am also contemplating applying for an H1-B visa through my employer , however the chances of me getting it are very remote- I realize. since the H1 quota was reached in one day in 2007.

Can you please point me to the posts where the TN->Green card has been discussed?
