HOW TO GET GUARANTEED NO USA ENTRY TIME RECORDED?

Post Sun Oct 21, 2007 11:29 am

Citizenship certificate guarantees NO record on entry time if enter by land?

My friend drives to enter USA twice. Once his passport was scanned which means entry time may have been recorded. But the most recent situation was neither passport is scanned nor any form required to fill. He just showed his passport in the car to the outside border officer and then allowed to enter.

If I enter by land on Citizenship certificate and do not show passport before next summer when passport is mandatory, am I guaranteed NO record on entry time? If not,
WHAT IS THE METHOD GUARANTEED NO ENTRY TIME RECORDED CURRENTLY?

There are no guarantees.

And to add salt to this wound you're feeling, I believe that as of 08, Canada and US will fully share info on passports. Right now, Canada only has access to info from entries into Canada, and ditto for the US. But soon, Canada will have info on all US and Canada entries, the same will be true for the US, so not only will they know your entries to the US but will also know of your returns to Canada. Basically, if you can't be fully legal, then you run the risk of.
-deportation
-refused entry for 5-20 years
-worse?

It's totally irrelevant because the US spends no time whatsoever hunting down Canadians who have overstayed, even if they have been in the country too long. They only bother if they have reason to believe you're a (serious) criminal.

I always remember that guy who was caught fund-raising for Gore in Utah back in 1999 and he got deported. He'd been there for 2 years and no-one ever bothered to check.

Read this if you want to know exactly how the new system will work: http://travel.state.gov/pdf/WHTI_final_rule_new.pdf

Oh yeah, and let me just add that overstaying isn't really a practical idea anyway unless you want to be a day labourer or something like that, because without an SSN you can't get a job and you can't get ID in most States with just a Canadian citizenship certificate so what records they take at the border is a relatively trivial point.

Canadians seeking status of "de-facto permanent US resident" without any proper visa attention:
(1) enter US by land
(2) Show citizenship card/birth card Only, do not present scannable passport to get your entry time recorded.
(3) Try entry before next summer when passport is mandatory.

Some people are self-employed and tax exempt. They are doing their own business without a SSN requirement like web (ebay)business, etc. Also I believe there are hundreds of reasons why some Canadians want to overstay without proper visas

You aren't tax exempt if you are self-employed! You have to pay tax. If you pay tax you have to pay social security, and you have to have an SSN. Plus you need ID, and if you maintain Canadian ID, I guarantee you the CRA will catch up with you. Without an SSN and proper immigration paperwork you cannot get US ID.

They weren't born yesterday.

The only way around it I know of as regards the SSN is to set up a corporation, and you pay yourself a dividend, so it's classed as investment income. However, this still doesn't get you around the ID problem, and dividends are not deductible against corporation tax so you end up paying way more tax overall.

So I would like to choose NOT to pay tax. Anyway money earned from some jobs can't be traced, really, especially eBay, as far as I know.

Like I said, they weren't born yesterday. You'll get audited sooner or later. I knew a guy in the UK who moved there from Pakistan and opened a shop, one day a tax agent from the local tax office down the road walked in there to buy a pack of cigarettes. Out of curiosity he went back to his office and looked for the guy's tax return - couldn't find it, so he sent an auditing team around and assessed him 20 years of taxes.

True story, because the tax agent is a friend of mine,.
