Good Evening Everyone -

I am new today to this group and I have already learned so very much. Here is my situation.

My hubby and I will be moving from Calgary to San Francisco on his L1 Visa in the next 2 months. We have one son who is seven. I would like to continue my university studies at Berkeley in the Fall of 2009. Our family is planning on staying in the US for at least 5 years. I have a couple of questions with regards to visas.

1. What are my options as a student? (I might want to work while I am waiting to attend class in the Fall of 2009)

2. Which visa would we apply for for our son to attend public school?

I do look forward to your advice.

Cheers
Darla

If your husband has L1, you and your son would be eligible for derivative L2. The L2 allows your son to attend any elementary/secondary school.

L2 spouses can apply for employment authorization, so I would assume you would also be eligible to attend university. You will likely have to pay "out of state" tuitions, which are really really high!

Thank you so very much fopr the information as well as the heads up on the higher tuition rates. How do I go about applying for the L2 visas for myself and my son? Thanks in advance!

I'm sorry, I honestly do not know. Maybe you could ask your husband's employer what forms are necessary. They've probably moved families before.

L-2 is applied for at the POE by Canadian citizens. If you are accompanying your husband he shows them his L-1B status and you show them a copy of your marriage certificate. Fill in the form and pay the fee.
