Husband H1B, is wife possible to get TN

Hi,

My husband will transfer from TN to H1B soon, then apply for green card. I will start to look for a job this year. I am a TD holder currently. Is it possible that I will get TN once I land a job?

His having an H1 will not prevent you from getting TN.

However, be sure, when he begins GC process, that your status is clearly communicated to the lawyer, as there is some timing/travel issues you need to observe at the point you file your I-485 (and EAD) to get GC, so that you remin legal from TN to EAD to GC.

I'm guessing that since his company is making him switch to H1 to get GC, that they are not as familiar with TN as they should, since he could file for GC without going thru H1 step.
