husband, wife living together out of UK four years or more?

husband, wife living together out of UK four years or more?

hello i found this on the ukvisas.gov.uk web site

"If you and your husband, wife or civil partner have been living together outside the UK for four years or more, and you meet all the necessary requirements to stay permanently in the UK, you may be granted indefinite leave to enter. These requirements include showing that you have the necessary level of knowledge of the English language and life in the UK"

now my question can we move to the UK and get ILR for me and our baby or we have to get 2 year visa and then go for the permanent one?
I have been living together with my wife outside the UK for more then four years she have British citizenship but was born and lived all her life in canada and we have a baby who is not eligible for British citizenship as my wife cant pass it to her because she was born and lived out side the UK will it make any deferent that we have been marred for over four years?

If you apply, and have completed the Knowledge of Life in the UK (KOL) test, you will be given ILE (indefinite leave to enter) this is the same as ILR except that it is issued outside the UK (hence the "enter" instead of "remain")

If you haven't completed the Life in the UK test, you will be issued with Settlement Spouse/Cp (KOL req)visa. This means that as soon as you pass the KOL test you can upgrade to ILR, no need to wait 2 years.

Does that make sense?

yes that make sense

but I didn't find that in any official website can you point me there? do i have to but that in the application or they give it automatically and what about the fees do i have to bay again to remove the KOL req?

also what about the baby she is not automatically British citizen because her mother was born in Canada and she was born here too?
