I-130 Visa

Post Sat Dec 17, 2011 3:20 pm

Hello,

So me and my husband got married in California. He is a German citizen and a Canadian permanent resident. I am a U.S. citizen from California. We both came back to Canada to do his visa i am just here as a visitor not working or anything while we do his visa. We sent in the I-130 and got accepted 15 days later. I tracked my status and this is what it said : On December 7, 2011, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

I am still waiting for my packet, but my question is are we going to be able to move to the u.s. now and finish the process there since i read somewhere you have to have your interview in the country of your marriage or do we have to stay here in Canada to finish the process. I am quite confused because we had been planning on moving in a few weeks but after researching now i am not sure if we can or not. So can we finish the process in the u.s. since we don't have to wait for a visa number since we are married or do we have to have interviews here and stuff. I would really appreciate your help i am stressed and i can't call customer service or anything until Monday and i am feeling impatient right now just because we were planning on moving really soon. Thanks in advance! :D

visajourney.com You have a ways to go yet! Check out the CR-1 forum on VJ has all the info you need!

He will have the interview in Montreal. ALL cr-1 interviews are done in Canada! From submitting paperwork to Interview time is anywhere from 6 months to around a year!! Please Visit VJ. Even a Canada section.

As well he is going to require a police background check from all places he has lived since the age of 16. The one from Canada is simple, it should cover all of Canada. RCMP does it (in most places, not all) and local police do them as well

You should have just stayed in the USA and AOS'd! But now as you have filed the I-130, you can't! Again, visit VJ

At the top of the CR-1 forum ,there are guides! Read them! At the very top are exaqmples of already filled out forms! Really take ur time and read over the guides! Montral consulate may even want proof of his Cdn PR status! Best of luck
