Will I need to leave the US for an interview? and what happens if I have exceeded the 6 month visitor period in the US?

No, adjustment of status interviews are held in the US, at USCIS district offices.

Just spoke to someone who said that it is illegal to apply for an AOS through my American wife while in the US?

Is this true?

Hello everyone, I'm new to the forum & hope I'm posting in the right place. My friend left Canada over 7 years ago to visit the US with her friend (an American). She (the Canadian) was only supposed to stay a few months but she's still in the US. She hasn't applied for citizenship or anything that way, and when her Canadian driver's license expired she didn't get a US one, she just stopped driving. She hasn't had a job there. Now she wants to return to Canada but is afraid that if she does she won't be allowed back in the US.

I'm wondering if she would be arrested? How can she go about making things "right" after all this time? Thank you for any information you can provide.

if she leaves the US, she will not be arrested when going home. The Canadian border patrol doesn't care that she overstayed in the US.

If she tries to go back to the US at a later date, she may be denied entry and she may be banned for a time, but that's the risk she took and she'll have to live with it I'm afraid.
